Becoming British through marriage – what you need to know

If you are married to or in a civil partnership with a British citizen, you may be eligible to apply for British citizenship through the naturalisation process under Section 6(2) of the British Nationality Act 1981. This route offers a slightly more flexible path than standard naturalisation and is one of the most common routes to acquiring British citizenship.

Who Can Apply?

You may apply for naturalisation as the spouse or civil partner of a British citizen if you meet the following criteria:

Key Eligibility Requirements:

  • You are aged 18 or over
  • You are married to or in a civil partnership with a British citizen
  • You hold Indefinite Leave to Remain (ILR), Settled Status (under the EU Settlement Scheme), or Indefinite Leave to Enter (ILE)
  • You have lived in the UK for at least 3 years before the date of application
  • You have not been absent from the UK for more than:
    • 270 days in the 3 years before your application
    • 90 days in the 12 months before applying
  • You meet the English language requirements – unless exemptions apply
  • You have passed the Life in the UK Test – unless exemptions apply
  • You are of good character

  • Shorter residence requirement – only 3 years (instead of 5 years).


Good Character Requirement

You must not have serious or recent criminal convictions, immigration breaches, or issues with unpaid taxes or dishonesty in previous visa applications. Parking fines and civil penalties are usually not a barrier but should be disclosed.
